Why We Need PoSH Training During The Covid-19 Pandemic: 

In light of the unprecedented situation created by Covid-19, we’ve witnessed a massive shift in the service sector where the workplace has moved from the office to homes. If your employees are working from home, they’re still protected under Indian laws and have to continue to abide by the mandatory policy formulated to prevent and redress complaints of sexual harassment under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, and rules framed thereunder, under the PoSH Law.

Never before has there been a greater need for Internal Committees (ICs) to stay updated and External Members, HR heads, and managers to understand not only the law, but also the complexities of PoSH compliances. Keeping this is mind, Ungender and Conduct are inviting you to a two-day certification workshop to provide your organisation and its members the skills for addressing sexual harassment at the workplace.

The PoSH certification workshop will be conducted on 23rd and 24th October, 2020, broken down into 5 hours for each day, with a lunch break in-between and an overnight assessment test.

Intent of the PoSH Law:

In this module, we will introduce the evolution and enactment of law on prevention of sexual harassment in India; from Vishakha to Nirbhaya. We will dissect the title and understand the objective and intent of law i.e. prevention, prohibition and redressal of instances of sexual harassment of women at the workplace.

Key definitions and their wide ambit:

Understanding the concept of ‘aggrieved woman,’ ‘workplace,’ ’employee’ and ‘sexual harassment’.

Documentation:

1) Understanding the requirements of a written complaint;
2) Are anonymous complaints acceptable?
3) What are the components of a complete complaint;
4) Understanding requirements of a written response
5) Witness statements
6) Transcript of meetings
7) Recommendations of interim measures
8) Inquiry report and its key components

Day 2 [10 AM to 3 PM]

Lunch break at 1 PM

Appeal to the authorities under PoSH Law:

A discussion on appellate authorities under service rules and Industrial Standing Orders Act and the lack of notifications.

Compliance under PoSH Law:

Key components of an effective PoSH Policy;
Statutory notice and its contents;
Is a Board resolution necessary for appointment of IC member?;
Components of an adequate awareness/ sensitisation session for employees;
Components of an orientation/ training session of IC members.

Penalties under PoSH Law:

A discussion on what punishments can be meted out in cases of instances of sexual harassment and proportionality of such punishment.
