05 PoSH Annual Report Advisory

The PoSH Annual Return serves as a statistic to analyse whether a company has complied with the PoSH Act, 2013, or not. As per the PoSH Act, 2013, the Internal Committee must prepare and submit a PoSH Annual Return to the employer. The employer must further submit the Return to the District Officer who ensures compliance with the provisions of the Act in the district.

The PoSH Annual Return must include the details of your PoSH policy, Internal Committee members, PoSH training for employees and IC, and the details regarding the complaints filed in your organisation.

Is there a format for the PoSH Annual Return?

There is a prescribed format for the PoSH Annual Return under the PoSH Act. The format for the Report is provided in the Rules framed under the Act, PoSH Rules, 2013. It includes relevant details about the number of complaints filed, disposed of, and pending; actions taken by the employer; and details of awareness and training programs.

Who prepares and submits the PoSH Annual Return?

The Internal Committee of every organisation is responsible for the preparation of the PoSH Annual Return. Once the Internal Committee prepares the Return, they submit it to the employer. The employer then submits the Return to the District Officer of the location where the organisation has its office(s).

Submitting the Annual Report is the responsibility of the employer under the PoSH Act, 2013. No third-party advisory or consultancy can do so on your behalf. However, we do provide you the address(es) where your organisation’s Annual Report needs to be submitted.

Is there any timeline for submitting the PoSH Annual Return?

Yes, the PoSH Annual Return shall be submitted to the District Officer by January 31st. Non-submission of the PoSH Annual Return amounts to non-compliance which can lead to a penalty of up to INR 50,000. Repeat non-compliance can also result in the cancellation of their business license.
